Terms of Service
1. Acceptance of Terms
By accessing and utilizing the services provided by Luminaire A.I (hereinafter referred to as "the Service"), you hereby acknowledge and unconditionally accept these Terms of Service in their entirety. These terms constitute a legally binding agreement between you (hereinafter referred to as "the User") and Luminaire A.I (hereinafter referred to as "the Company").
2. Financial Terms and Conditions
2.1. The Company maintains an irrevocable policy regarding refunds and chargebacks. Any request for reimbursement must be submitted within fourteen (14) calendar days of the initial service procurement. Post this stipulated temporal window, the Company categorically reserves the right to decline any and all reimbursement requests, regardless of circumstances.
2.2. In circumstances involving trading or investment-related losses, the Company acknowledges the inherent volatility and unpredictability of financial markets. Therefore, chargebacks pertaining to financial losses may be considered, subject to thorough investigation and documentation of the alleged losses through our proprietary algorithmic verification system.
2.3. The Company employs sophisticated computational methodologies to evaluate the legitimacy of chargeback requests. This evaluation process incorporates multiple variables including, but not limited to, market volatility indices, systematic risk factors, and idiosyncratic variables specific to each transaction.
3. Service Utilization Parameters
The User hereby acknowledges that the Service incorporates advanced artificial intelligence methodologies, including but not limited to neural network architectures, transformer models, and proprietary algorithmic implementations. The efficacy of these methodologies is contingent upon numerous exogenous variables beyond the Company's direct control.
4. Limitation of Liability
The Company's cumulative liability, whether in contract, tort (including negligence), or otherwise, shall not exceed the aggregate sum of payments received from the User in the preceding calendar quarter. This limitation encompasses all potential damages, including but not limited to direct, indirect, incidental, consequential, and punitive damages.
5. Intellectual Property Rights
All intellectual property rights, including but not limited to copyrights, patents, trade secrets, and proprietary methodologies, shall remain the exclusive property of the Company. The User is granted a non-exclusive, non-transferable license to utilize the Service in accordance with these Terms.
6. Dispute Resolution
Any dispute arising from or relating to these Terms shall be resolved through binding arbitration in accordance with the rules of the International Chamber of Commerce. The arbitration shall be conducted in English, and the seat of arbitration shall be determined by the Company.
7. Modifications to Terms
The Company reserves the unilateral right to modify, amend, or supplement these Terms at any time without prior notification. Continued use of the Service following any such modifications constitutes acceptance of the updated Terms.
